For example, your rented property has a boiler, fire and cooker; costing a total of £120. We are more than happy for you (either landlord or letting agency) to organise our visit or we can liaise directly with the tenant a suitable time and date to carry out our checks; at times this is more beneficial as it saves the time between. A landlord certificate is known by numerous names in the UK such as Annual Gas Safety CheckGas Safety Record & CP12. By law, under the Gas Safety (Installation & Use) Regulations 1998 it is your responsibility as a landlord and for any rented property to get / have a Gas Safety Certificate renewed every 12 months.

A number of fatalities in the early 1990’s highlighted the dangers of gas appliances fitted in rented accommodation. Investigations into these fatalities showed that in many cases, gas appliances were old, had no necessarily been fitted correctly at the time of installation, later alterations to the premises had affected the safe operation of the appliance, or the appliance had not been checked or maintained over the years. 

As a result, the HSE introduced legislation (Regulation 36 of GSR) that made it a legal requirement for gas appliances provided by landlords to be safety checked (not necessarily serviced) at least annuals and records of those checks to be kept. The legislation places these duties on landlords and makes it very difficult for a landlord to pass these responsibilities onto a third party.

Key Points to Remember:

  • All appliances provided by the landlord as part of the tenancy agreement must be safety checked at least once a year
  • A record of these checks must be kept by the landlord for at least 2 years
  • A copy of the check / record must be passed to anyone in lawful occupation of the rented premises within 28 days
  • The safety checks must be carried out of a Gas Safe Registered engineer – M. A. Parkes
  • The record must include details of the date of the check, address, appliances checked and location of appliance
  • The record should make clear any defects found and any remedial action taken or needed
  • The duty to have safety checks carried out extends to appliances and their associated flues.

Even though it is only a legal requirement to obtain a landlord certificate every 12 months, we highly recommend intermediate checks between tenants too.

Having worked with many landlords and letting agencies over the years, we have come across some very dangerous situations that previous engineers have overlooked or quite simply not bothered to check. Lets say you have a gas fire, was it removed on your previous landlord gas safety check? Well it should be. 

Minimum checks on landlords annual safety checks:

  • Burner pressure and/or gas rate
  • Operation of safety devices
  • Spillage tests
  • Check sufficient ventilation
  • Sufficient fixed / stable
  • Flue inspection
  • Flame picture (where visible)
  • Condition of case and case seals
  • Cleanliness and size of catchment space on radiant and inset live fuel effect gas fires
  • Condition, number & position of artifical coals or logs on ILFE or DFE fires
  • Condition and position of flexible hose on a cooker
  • Finally, is the appliance safe to use and label accordingly
